Privacy notice
This notice applies to the againstfomo.com website and to the apps and services Againstfomo («we») offers or operates, including Daypi Hobby Marketplace and our video production tool («the apps»).
Data controller: Againstfomo. Contact for any privacy matter: contacto@againstfomo.com.
1.When we are the controller and when the processor
When we run an app of our own, we are the controller of the personal data processed there. When we build or host custom software for a client, the client is the controller of its own users’ data and we process it on its behalf under the contract we sign with it.
2.Data the apps process
Depending on the app and on what you or your organization choose to use, we process:
- Account: name, email address, credentials (passwords are stored hashed with a one-way algorithm) and role within an organization.
- Tenant data (the store or business using the app): catalog, orders, the business’s customers, settings and the files you upload.
- Payments: charges are processed by external payment providers. We do not store your full card number; we receive from the provider the status of the transaction and references to reconcile it.
- Technical logs: IP address, browser type, date and time, errors and audit records of actions, which we use for security and support.
- Communications: the messages you send us by email or through contact forms.
- Content for artificial intelligence features: the text, images, audio or video you choose to send so that a result is generated.
- Google user data, only if you connect your Google account to an app (see its own section).
We do not ask for sensitive personal data. If it reaches us inside content you upload, we process it only to provide the service to you.
3.What we use it for
- To create and manage your account, authenticate you and provide the service you contracted or use.
- To protect the apps: security, fraud and abuse prevention, and fault diagnosis.
- To charge, invoice and handle suspension for non-payment.
- To support you and answer your messages.
- To meet legal obligations and respond to requests from a competent authority.
We do not use your data for behavioral advertising and we do not sell it.
5.Artificial intelligence features
When you use an AI feature, we send the AI provider only the content needed to produce the result you asked for. The result may contain errors; review it before you use it.
6.Google user data
Our video production tool («video-factory») can connect to your Google account only if you authorize it. On Google’s consent screen it requests a single Google Drive permission:
- drive.file: access to the files the app creates or that you open or share with it, to store the videos produced there.
To read the input material (for example, recordings and assets), we do not ask for another permission over your account: you share a Drive folder with our service account, which has read-only access (drive.readonly) and can only read what that folder contains.
We use that data only to provide you that feature and for no other purpose. We do not sell it, we do not use it for advertising, we do not use it to develop or train general-purpose artificial intelligence models, and no person reads it unless you authorize it, it is necessary for security or to investigate abuse, or the law requires it.
Access tokens are kept while the connection is active. You can revoke access at any time from your Google account permissions or by writing to us, and we delete the Google data we hold when you ask or when the connection ends.
Againstfomo’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
7.How long we keep it
We keep data while your account is active and for as long as needed to meet legal obligations, resolve disputes and keep backups. After that we delete or anonymize it. You can ask for deletion earlier, subject to what the law requires us to keep.
8.Security
We apply reasonable technical and administrative measures to protect data: encryption in transit, role-based access control and audit logs. No system is infallible; if a breach affecting your data occurs, we will notify you as the law requires.
9.Your rights (ARCO)
Under Mexican law on the protection of personal data held by private parties, you may exercise your rights of Access, Rectification, Cancellation and Objection (ARCO), as well as withdraw your consent and limit the use or disclosure of your data.
To exercise them, write to contacto@againstfomo.com with your name, a way to reply, a copy of an identification and a clear description of your request. We will answer within the deadlines set by law. If you believe your right was not honored, you may go to the competent data protection authority.
11.Minors
The apps are not directed to people under 18 and we do not knowingly collect their data. If you believe a minor gave us data, write to us and we will delete it.
12.Changes to this notice
We may update this notice. We will publish the current version on this page with its date and, if the change is significant, notify you by a reasonable means.
